These terms explain how the MyScapez marketplace works, what we expect from homeowners and Businesses, and the limits of our responsibility.
These terms apply when you use myscapez.com (the “Platform”), which is operated by Myscapez (ABN 79 501 664 159) (“MyScapez”, “we”, “us”). By using the Platform you agree to these terms. If you do not agree, please do not use it.
MyScapez is an online introduction and booking platform. We help homeowners and other customers (“Customers”) find local lawn mowing, lawn care, gardening and landscaping businesses (“Businesses”), and we help Businesses promote their services.
MyScapez is not a party to the contract for services between a Customer and a Business. We do not supply, perform, supervise, direct or guarantee any mowing or garden work. Any agreement for work, including its scope, price, timing and quality, is made directly between the Customer and the Business.
When you request a quote, you agree that we can share your request with matched Businesses so they can contact you. You are responsible for checking that a Business suits your needs, and for agreeing the price, timing and scope of the work with it directly.
Businesses are independent contractors. They are not employees, agents or partners of MyScapez. Each Business is solely responsible for its work and its quotes, and for its staff and subcontractors, equipment, workplace health and safety, licences and permits, and any property damage, injury or loss that its services cause.
Businesses must provide accurate details, including a valid ABN where one is given. They must hold any insurance, licences and registrations the law requires, and they must comply with the Australian Consumer Law and all other laws that apply to their services.
Nothing is published straight from the listing form. We review every listing before it goes live, and we may refuse, edit for formatting, suspend or remove a listing at our discretion. Reviewing a listing is not an endorsement of the Business, and it doesn’t guarantee its quality.
Each Business must hold current public liability insurance with cover of at least AUD $10 million per occurrence, plus any other insurance the law requires, such as workers’ compensation. The Business must keep this insurance in place while it is listed, and must give us a certificate of currency within 7 days if we ask for one. We may suspend a listing until we receive proof of cover.
Each Business indemnifies MyScapez against any claim, loss, liability, cost or expense (including reasonable legal costs) arising from the services it provides, its breach of these terms or of any law, or the negligent or wrongful acts or omissions of the Business or its staff or subcontractors. The Business does not have to indemnify MyScapez to the extent that MyScapez’s own negligence, breach or wrongful act caused or contributed to the loss.
Any dispute about a job, such as its quality, price, timing, damage or injury, must be resolved directly between the Customer and the Business. MyScapez may choose to help, for example by passing on messages or reviewing a listing, but it has no obligation to do so and does not decide the outcome. This does not affect any rights you have against MyScapez under the Australian Consumer Law, or our responsibility for the Platform itself.
Businesses can list for free.
Customers pay a $59 callout fee for each booking. MyScapez keeps half of it ($29.50), and the Business gets the other half ($29.50). The Business also gets the full amount of its job quote, which it sets itself. The quote is agreed between the customer and the Business.
We try to keep the Platform accurate and available. To the extent permitted by law, the Platform is provided “as is”, and we exclude all warranties, representations and conditions that are not set out in these terms, including implied warranties of fitness for purpose and quality. We do not guarantee that a request will be matched, that a Business will respond or be available, or that the Platform will be free of errors or interruptions. Reviewing or listing a Business is not an endorsement or guarantee of its work.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded. Where we are allowed to limit our liability for failing to meet such a guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
To the extent permitted by law, and always subject to the Australian Consumer Law section above: (a) MyScapez is not liable for the services Businesses provide, or for any act or omission of a Customer or Business; (b) MyScapez is not liable for any indirect, special or consequential loss, or for loss of profit, revenue, data or opportunity, however it arises; and (c) MyScapez’s total liability to you in connection with the Platform and these terms is limited to the greater of AUD $100 or the total amount MyScapez received from you in the 12 months before the claim. These limits do not apply to the extent that loss is caused by MyScapez’s fraud, wilful misconduct, or other conduct for which the law does not allow liability to be limited.
The Platform, including the MyScapez name, logo, design and content, belongs to us or our licensors. Businesses keep ownership of the content they submit, and give us a non-exclusive, royalty-free licence to display it on the Platform and use it to promote the Platform while their listing is active.
We may suspend or end your access to the Platform, or remove content or listings, if you breach these terms, if the law requires it, or to protect users or the Platform. You can stop using the Platform at any time, and you can ask us to remove your listing.

We may change these terms. The current version will always be on this page with its date. If you keep using the Platform after a change, you accept the updated terms.
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.
